    How do i remove my tenant that lives in/created a hovel that was my lovely previous home? she lives alone in my 3 bed house in a cul de sac in the country ....she owes me £10,345 as of 23rd april 2023?... assured tenancy started september 2015.... since lost job now claiming benefits milking her 'health' issues.....We have to now pay out an absolute fortune including having to do courses that are entirely futile as we are selling the property as soon as shes out ...Welsh assembly are off loading these people on landlords which has prompted them to sell up asap ....solicitors are overwhelmed with eviction notices we have been told....massive court/solicitors fees WE have to fork out.....WARNING TO OTHERS DO NOT RENT OUT PROPERTIES IN WALES!!!

    I am a private tenant. (paid by Housing Benefits) in Newcastle co down I am also on a waiting list for housing since 2019 I believe. On April the 8th I received a phone call from the daughter of my landlord, who told be because of her mother's mental condition ( she is 85y old and got dementia ) she is now taking over her Mother's finances including the House I am renting. One hour later I met her and she presented me right away with a new contract. The rent was increase by £20 a month. I told her that her Mother promised me that she won’t increase my Rent as long as I live here, and she is still alive. (this was a verbal promise) The daughter said, well everything is going up , that’s it ! Anyway I signed the new contract but told her that I am not happy about it, she answered; That’s OK Later I was able to read the contract (she didn’t give me much time to read while I was with her) there was a part in bold , that she will increase the rent on a yearly basis . Obviously I am not that happy about that either. So I crossed this yearly increase part and my signature and returned this contract to my Landlords letterbox. Yesterday I received something through my letterbox, an eviction notice. Looks like my “I am not happy” response backfired big time. Now I am in Trouble. I don’t have the finances or the physical or mental strength for a move. Can you please advise what to do ? I contacted everyone

      Hi John, the Act allows more time for landlords with existing tenancies to provide a written statement for their contract holders. Where a landlord has an existing tenancy in place prior to December 1st, a written statement of the converted contracted must be given to the contract holder by 1st June 2023.

    The problem with these changes is that they make renting property in Wales more difficult and confusing for landlords, they also change the risk calculation for landlords if they think the only way to get possession of the property is to wait 1 year from the start of the tenancy, or alternatively try going to court with all the added expenses & good luck with getting a date for that in anything resembling a timely manner. (12 months+) Allot of landlords are now either looking to get out of the sector or like myself I'm looking at purchasing new properties in England and switching investment strategies. With a housing crisis and lets be clear it is a crisis right now with tenants desperate for somewhere to live these types of changes are tone deaf. You need fairness to be on both sides of the tenant and landlord relationship, when that becomes skewed too far in favour of one party (lets say the tenant in this example) then landlords just won't take the risk and invest. Also with my properties and like many other landlords I provide bills included, with the current energy crisis this is a huge challenge and I've been taking a financial hit as I try to limit any rent increases, if I can now legally only put the rent up once in every 12 month period then how on earth will this be practical? I have noticed to try to mitigate these changes landlords are now massively increasing the rents for new tenants, I can see that many have gone up by about 80%, they are also asking for 12 months rent in advance and guarantors who own their own homes for every contract - which as well as the reduced housing stock is another of the unintended consequences that these types of changes are having on tenants. The intentions for the policy changes may well have been good but the reality of large changes while there are so many other pressures facing both landlords and tenants is that the Welsh Government is stalling the tenancy market and worsening the situation. Along with section 24, Article 4, EPC changes and mortgage interest rises landlords have really had enough.

    Thanks for the video, in regards to periodic contracts will they be mandatory for all rental properties, and if so do we know when that might be please? We have been asked to renew our fixed contract, but are trying to avoid getting tied into a 6 month upwards contract.

      The proposals set within the White Paper are for periodic contracts to be mandatory for ALL rental properties. However, as this is a White Paper, the Government’s proposals are subject to change and will likely be consulted on. During this time, we will work with our regional executives to ensure the concerns from the sector are raised. As it stands, there is no set date for any legislation to be introduced, but what we do know is that the Government plans to provide at least six months’ notice for all tenancies to be made periodic once the Government knows the date that legislation will be passed.

    Lots of wishful thinking here!Even if the landlord wishes to serve notice for the tenant to quit the property and should the tenant wish to object /resist ,the notice period together with the compulsory arbitration mechanism will make possession a very long drawn out affair.The devil will be in the legislative detail.The Government want the small time BTL sector gone and are moving towards a form of protected tenancies as per the 1970s.The Government are now purely advocates for Shelter.

    What will happen if the landlord decides to sell his property and vacated the tenant but later the property did not sell for various reasons . In this situation, can the landlord allowed to put the property back on the rent for different tenant or what are his choices ?

      It’s worth reiterating that these announcements are part of a Government White Paper. This means it shows what the Government wants to do but the full details still need to be worked out and legislation is required before any of these changes can be implemented.     When do you think the secound phase will be voted on? I have read from maybe months to years...I would like to buy my fathers house in 5 years time when his Mortage term is up, but would rather wait until it becomes much cheaper to extend the lease. Do you think all of this will be sorted in 5 years time?

    Just makes it harder for people on dole because it will be them picking up the tab because landlords wont be footing the bill it will be passed on to them well done to all local coucils who have done this it doesnt work and you already have powers to sort rogue landlords out but dont use them and why are council houses exempt they can be just as bad look at local news lately

    We see the abolishing of Section 21 as a disaster. We have worked in our community for over 20 years as the SWCG South Westcliff Community Group. Our area is full of both rented and house owner accommodation. We have only had to use Section 21 once in that time but it was invaluable. If it is abolished it will mean our only recourse for action and help is through EH Environmental Health inspectors. Since this service is virtually non-existent, to a point of being almost worthless, we cannot see how noise problems will be sufficiently dealt with in the future. Noise is a growing problem in our densely populated urban areas. The continuing problems around noise/nuisance need to be addressed as a serious issue within all communities of the UK.

    Very helpful bite-size videos. What about a tenant wanting to leave ealry? What would be considered "reasonable marketing costs"? If I only have one property to let, then would my monthly subscriptions to the property portals be considered as "reasonable" for the period of marketing?

      Under the Tenant Fees Act agents can charge an early surrender fee, but the fee cannot be more than the total rent outstanding on the property and it should be reasonable. The Government has suggested that agents will be able to charge the landlord's costs in reletting the property, plus the amount of rent owing until the new tenant moves in, up to a maximum of the total rent outstanding on the property. It’s covered on page 56 of the Government’s guidance assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/791273/TFA_Guidance_for_LandlordsAgents.pdf In terms of reasonable costs, we recommend that agents charge the tenant the landlord’s tenancy setup cost as detailed in the landlord fee schedule and any rent until a new tenant moves in.
